1. Who we are

AQUAVISTA INC (“AquaVista”, “we”, “us”) is a corporation incorporated in Colorado, USA, with its registered address at 310 E 17th Ave Apt 510, Denver, CO 80203, USA. These Terms of Service govern the use of this website and the provision of our services.

2. Services

We provide advertising campaign management, advertising purchasing (media buying), and ad creative design services to business clients under individually agreed statements of work. The information on this website is a general description of our services and does not constitute a binding offer.

3. Client accounts and budgets

Advertising budgets are agreed in writing and prepaid by the client. AquaVista places media on the client's behalf on advertising platforms including Google, Meta, TikTok, and Amazon, and charges a service fee as agreed in the applicable statement of work. Budgets are reconciled to platform invoices.

4. Payments

We accept payment by bank transfer or other agreed electronic payment methods, from accounts held in the client's own name. We do not accept cash or checks, and we do not accept payments from third parties.

5. Acceptable use

We do not provide services for content or industries that are unlawful or prohibited by the advertising platforms we use, including adult entertainment, gambling, weapons, and cannabis. We do not serve clients subject to applicable sanctions programs.

6. Intellectual property

Creative assets produced for a client are assigned to the client upon full payment of the related fees. AquaVista retains the right to reference non-confidential work for its own portfolio unless otherwise agreed.

7. Disclaimers and liability

Services are provided with professional skill and care. Advertising results depend on many factors outside our control and are not guaranteed. To the maximum extent permitted by law, our aggregate liability arising out of the services is limited to the service fees paid to us in the three months preceding the claim.

8. Termination

Either party may terminate a statement of work with thirty (30) days' written notice. Prepaid, unspent advertising budgets are refunded to the originating account.

9. Governing law

These terms are governed by the laws of the State of Colorado, USA. Disputes are subject to the courts located in Denver, Colorado.
